TERMS AND CONDITIONS OF USE OF WEBSITE


1. GENERAL PROVISIONS

The following “Terms and Conditions of Online Sale” are valid between You and KORA, including KORA Llc. and its official retail sole entrepreneur partner and representative KOROSTINA OLENA in particular (henceforth: KORA; may be referred to as “us” and “we”) and will apply to all Orders placed on KORA’s Website www.kora-knitwear.com, and Orders placed by e-mail, phone, by chat with KORA’s Customer service team, as well for orders made through official Instagram (kora.knitwear) and Facebook (KORA_international) accounts that are shipped to the Countries outside Ukraine.

These “Terms and Conditions of Online Sale” owned and managed by KORA Llc. – the owner of the official Website and all Intellectual Property Rights, including but not limited to Ukrainian certificate of registered trademark “KORA” ™ as well as the rights to use the domain www.kora.ua, are included in the present Contract of sale (“Contract”).

Products are sold on the Website www.kora-knitwear.com under the name KORA by the official retail sole entrepreneur partner Elena Korostina; Register address 04211, av. Heroiv Stalinhrada 10А/8/34 Kyiv, Ukraine; Register Number 20690000000036947 (from 28.07.2016) (henceforth “The Seller”).

These “Terms and Conditions of Online Sale” are a part of “Terms and Conditions” and along with all other “Terms and Conditions”, our “Privacy and Cookies policy”, together with all the documents to which they refer and your Order Confirmation constitute the electronic public Contract between You and KORA for the supply of Products purchased remotely using official channels for distance selling process.

No other terms and conditions shall apply. The Contract can’t be modified unless KORA agree to vary it in writing or by e-mail.

The contract may be formalized, at your choice, in any of the languages in which the «Terms and Conditions» are available on the Website.

By stating that You have read and accepted the “Terms and Conditions” when You place the Order through the Website, You confirm your unconditional acceptance and agree to observe, in your relations with “The Seller” the official retail sole entrepreneur partner Elena Igorevna Korostina, these “Terms and Conditions of Online Sale” as well as the payment terms described below.

Please make sure you have read and understood the “Terms and Conditions” as well as our “Privacy and Cookies Policies” before placing your Order and using the Website. If you do not agree to the “Terms and Conditions”, you must not place an Order for Products through the Website.

A copy of the “Terms and Conditions” can be stored electronically or printed by all Users of our Website for future reference.

The purchase of Products on this Website is allowed only to Customers.

Please note that KORA does not guarantee that all Products presented on the Website are in stock or are available for purchase. KORA reserves its right to stop selling a Product. If you have any questions concerning the “Terms and Conditions”, you can contact us by e–mail: knitwear@kora.ua.

2.  CHANGES TO THE TERMS AND CONDITIONS OF ONLINE SALE

KORA reserves the right to change, modify, revise, add or remove portions of these “Terms and Conditions of Online Sale” by updating this document, at any time, in its sole discretion and without prior notice to you. Changes to these “Terms and Conditions of Online Sale” will be communicated by placing a notice on this Website.

We thus invite you to check these “Terms and Conditions of Online Sale” periodically. If you do not agree to any such change, you must discontinue the access or use of the Website. By continuing the use of the Website following the posting of changes, you accept and agree to the changes.

The date of the latest update is found in the final section of the “Terms and Conditions of Online Sale” as well in the head of this document. Each purchase is subject to the “Terms and Conditions of Online Sale” in the version applicable at the date of placing your Order, so no such changes to the “Terms and Conditions of Online Sale” will apply to any Order for which you have already received an Order Confirmation. Please inform yourself about the applying version of “Terms and Conditions” before placing your Order.   

Any modification or amendment to these “Terms and Conditions of Online Sale” will immediately become effective after being published on this Website and will regulate all the subsequent sales of Products.

Any derogations to the “Terms and Conditions of Online Sale” will only be effective if agreed upon in writing between the parties.

3. RIGHTS AND OBLIGATIONS

The Customer’s failure to fulfill his obligations regarding the payment of the Products ordered by him is considered his unilateral withdrawal from this Contract in full, which, accordingly, has the effect of terminating in full all the obligations of “The Seller” in respect to this Contract.

4. PRODUCTS AND AVAILABILITY

The Products offered on this Website www.kora-knitwear.com are only available for Countries outside Ukraine. 

All information about the Products published on this Website is for descriptive purposes only.

We will have the right, at any time and without previous notice, to make changes, to modify, vary or withdraw (on either a permanent or temporary basis) some of the products and services and/or the information, features and specifications of Products and services displayed on the Website, including without limitation information about prices, description or the availability of those Products and services.

Changes will not however affect the price, availability or description of any Products for which you received the Order Confirmation.

Although we make any reasonable efforts to the maximum extent permitted by applicable law to ensure that: the prices and other information about Products accessible and displayed on the Website is accurate and constantly up-to-date, however, KORA does not accept any responsibility for the correctness, completeness, accuracy or currency of any information on the Website, including but not limited to Products description, pricing and/or availability on the Website.

The inclusion of any Products or services on the Website does not imply, warrant or guarantee that all these Products or services presented on the Website will be available through the Website if you wish to place an Order for such Products and/or use such services at any particular time or at the time of your Order.

We have made every effort to display, as accurately as possible, the colors of our Products that appear on the Website. However, the actual color you will see will depend on your computer settings and we cannot guarantee that your computer will accurately display our colors. If some Products turned out to be out of stock, we will contact you shortly, by phone or by e-mail, to verify your interest in the fulfilment of a partial Order, or whether you intend to cancel the Order. If we already have received payment for such Order, we will refund the amount of your Order or a part of it, which was cancelled.

5. PRICES

The prices of the Products are indicated on the Website and will be confirmed in your Shopping Cart, on the Order checkout page, in Order Summary, in the Order Processing Receipt, in the Order Confirmation as well as in the e-invoice you receive after your payment.

We reserve the right to vary and modify the relevant price of our Products at any time. Incorrect prices for Products will not be binding for “The Seller” or the Customer in any case, even after the Customer has received the Order Processing receipt. “The Seller” is under no obligation to accept, confirm or execute any Order for Products published at an incorrect Purchase price and reserves the right to refuse or cancel the Order.

If we discover an error in the price of any Product you have ordered, we will inform you as soon as possible and give you the option of reconfirming the Order at the correct price or cancelling it. If we are unable to contact you, the Order will be treated as cancelled and if you have already paid for the Products You will receive a full refund.

We will not alter the price of any Product after we send you the Order Confirmation.

Any amendments made to the prices will have effect from the date of their publication on the Site.

Please be aware that prices charged for any Products purchased on the Website may vary depend on the selected country and applicable duties in different countries. Prices are inclusive of VAT unless stated otherwise.

At the checkout, Total cost of Products in your Order (Subtotal) will be reduced by the amount of VAT tax, which you will have to pay to the currier upon the delivery.

The prices displayed on our Website/Instagram/Facebook include VAT but exclude shipping charges.

The TOTAL cost of your Order will include SUBTOTAL cost of products in the Order and Shipping charges, and will exclude VAT tax, which you will have to pay to the courier upon the receipt of your Order.

Unless specifically stated otherwise, the total amount of shipping charges, inclusive of VAT, will be debited in full to the Customer (“Shipping charges”). The total amount of Shipping charges will first be calculated, added to and shown on the Order checkout page, then in Order Summary and will be stated in the Order Processing, Confirmation and Completed e-mails sent to the Customer following placement of the Order. For more details, please, refer to the information provided in the “Shipping, Delivery and Order Tracking” section.

All prices of Products, Shipping charges and other costs debited to the Customer published on the Website are expressed in EUR, US Dollar depend on the Country of your delivery.

The “TOTAL” amount of the Order is determined by total cost of products in the Order placed in the virtual basket (minus VAT tax) and the shipping charges.

The “TOTAL” amount of the Order will be repeatedly shown on the checkout page, in the Order Summary during the checkout procedure and in the Order Processing, Confirmation and Completed Receipts.

You may pay by credit card, e-wallet (save for possible restrictions provided by the applicable laws and regulations), as listed on our checkout page.

Payment must be made in the currency as indicated on your Order before you place it. Please be advised that you may sustain some extra charges imposed by your credit card issuer or by your bank, for which we deny any responsibility.

6. PLACING AN ORDER

To place an Order, you must be 18 years of age or over, by placing an Order you represent that you are at least 18 years of age.

The Customer independently and at his own discretion selects the Products available and offered for sale on the Website.

Please, pay attention that the assortment, the selection and availability of Products and services, as well as prices and currency may vary and change according to the selected country.

Before you place your Order, you will be given the opportunity to correct any input errors, review your selections, the information you have provided and the total price of your Order. Please note that Products in your shopping Cart are not reserved and may be purchased by other Customers until you have placed the Order at checkout and received the Order Confirmation e-mail. If prolonged inactivity causes your connection to the Website to fail, your selection of Products may be lost. In such case, you will be required to re-enter your selection of Products to the shopping Cart.

If you place an Order by telephone, you will have to register on the Website during the call and provide us with an e-mail address.

Users cannot make any purchase under someone else’s identity unless strictly authorized to do so by the identity holder.

You are responsible for maintaining the confidentiality of your password and restricting access to your password and Personal Account. You agree to accept responsibility for all purchases and activities that occur under your Personal Account.

Products sold on this Website are not meant for resale.

You will have to select the Product on the Website, select color and size. If you wish to proceed with the purchase and place your Order, you may choose one of the following options:

– “BUY IN 1 CLICK” purchase. You may proceed with your Order without any registration, entering delivery, invoicing and payment details. You will see “BUY IN 1 CLICK” button directly on the Product page. We will send you information about your Order on the e-mail. Then our manager will contact you shortly to confirm and set all Order, payment and shipping details. After all the details of your Order are set and confirmed, you will be able to pay your Order in your «Personal Account» on our Website.

– Website checkout option by adding Products to your “CART” and clicking on “CHECKOUT” button. In this case, you may login, if already registered, or create a new account. Otherwise, continue with your purchase as a guest.

Once you have selected online payment method and click on the “SUBMIT ORDER” bottom you will be redirected to the payment page where in order to finalize the checkout you will click on the “PAY” button.

If you need to clarify any details regarding your order, you can apply for a Pre-order. Once you have selected Pre-order option and click on the “SUBMIT ORDER” bottom, we will send you information about your Order on the e-mail. Then our manager will contact you shortly to set and confirm all Order details. After all the details of your Order are set and confirmed, you will be able to pay your Order in your Personal Account on our Website.

Each Order placed constitutes an offer to purchase Products from us and will be considered a contractual purchase proposal, and also indicates your full and unconditional agreement and acceptance of all Terms and Conditions without any exceptions or limitations, and confirms that you are familiar with its terms prior to placing the Order. All Orders placed by you are subject to their availability and Confirmation by us.

By clicking on the “SUBMIT ORDER” or “PAY” button, the Customer confirms that he has been notified in a convenient and accessible way for him, in accordance with the requirements of Part 2 of Article 13 of the Law of Ukraine “On the Protection of Consumer Rights” by “The Seller” of:

•        The name of “The Seller”, his location and the procedure for accepting a claim;

•        Main characteristics and consumer properties of the Products chosen by the Customer;

•         The price of the Products selected by the Customer;

•        Method, procedure and conditions of payment and delivery of the Products selected by the Customer;

•        Warranty obligations of “The Seller” and other services related to the maintenance or repair of the Products selected by the Customer (if available);

•        Warranty period and service life of the Product selected by the Customer, mandatory conditions of use of the Product and possible consequences in case of non-fulfillment;

•        Period for accepting proposals and Confirmation of the proposal (offer) regarding the conclusion of this public Contract;

•        Other terms of delivery or performance of Terms and Conditions;

•        Minimum duration of the Terms and Conditions if it provides for periodic deliveries;

•        The cost of electronic communications, if it differs from the maximum tariff;

•        Procedure for terminating this Contract;

•        Other conditions on which the Product is offered for sale.

By clicking on the “SUBMIT ORDER” or “PAY” button, the Customer confirms that before ordering (purchasing) the Product in accordance with the requirements of Article 15 of the Law of Ukraine “On the Protection of Consumer Rights” he received all necessary, available, reliable and timely information about the Product selected by him, which fully ensured the possibility of a conscious and competent choice of this Product.

Please, pay attention that your Order will be subject to custom duties and local VAT tax, which you will have to pay to the courier upon the receipt of your Order. You can review the amounts of duties and VAT taxes in your country by following the link. At the checkout, Total cost of Products in your Order (Subtotal) will be reduced by the amount of VAT tax, which you will have to pay to the currier upon the receipt of your Order. We are pleased to inform you that we will refund the amount of VAT-tax to your card after Order Confirmation and before shipping.

The courier will notify you on costs to be paid and the procedure of payment as well as other formalities that are required to be followed by the local legislation at the time the Products are delivered to you. The Orders outside Ukraine will be processed only following your approval of the custom duties and local VAT payment.

7. PAYMENTS

Orders can be payed using major credit cards, debit cards, e-wallet or other methods of payment available on the Website.

This Website uses Secure Sockets Layer (SSL) technology to guarantee a higher standard of safety on any purchase of Products.

“The Seller” will proceed to charge the TOTAL amount of the purchase after you have placed your Order through the Website.

“The Seller” reserves the right to cancel a transaction and the relevant Order in the event that it appears that fraudulent use is being made of the Payment method adopted for the Order. Moreover, “The Seller” and the Website will not be responsible in the event that illegal use is made of a Payment method by third parties which is not connected to any error or negligence by the Website or “The Seller”.

Online payment service on the Website  is carried out by payment system WayforPay that provides guaranteed payment security in accordance with the Rules of the international payment systems Visa, MasterCard and international standards on the principles of confidentiality and security of making a payments, for which the world’s leading technologies and standards in the field of security and cyber security and the most modern methods of verification, encryption and data transmission over closed communication channels are used to protect your payments and customer cards.  

WayforPay – multifunctional payment aggregator and system acting on behalf of limited liability company FINANCIAL COMPANY «WayforPay», with its registered office on 2 Poeziyi str,. App10, 08205, Irpin, Ukraine; registered in the Unified State Register of Legal Entities No. 39626179 on February 06, 2015; acting on the basis of National Bank of Ukraine License No. №21/1064-rk issued on June 08, 2023 (reissued on May 24, 2024) – for the money transfer without opening of the account.

The system uses Smart 3D Secure, Visa Secure and Mastercard SecureCode Technologies, complies with GDPR and supports the HTTPS protocol.

Moreover, WayForPay has its own multi-level Antifraud protection system for monitoring transactions and protecting against fraud. WayForPay Antifraud uses its own scoring model, which helps to identify, analyze a transaction, promptly and accurately determine and prevent fraudulent transactions.

Entering bankcard data and authorization of payments for Orders is carried out on a separate secure payment platform page; as a result, “The Seller” will not directly manage any financial information relating to the Payment method used by the Customer, nor will the Website process any financial information provided for the completion of the Order.

The Payment system responsible for the automatic retention and processing in a secure environment of the information pertaining to each order, including details of the credit card used.

The Payment system protects the credit/debit card details by encrypting sensitive information to ensure that such information is passed securely between the Customer and this Website, on one side, and between this Website and the payment processor, on the other side.

In the unlikely event of error, negligence or any wrongdoing in relation to the management of the transaction linked to an Order by the payment system, neither “The Seller” nor the Website will be responsible for such error, negligence or wrongdoing.

You will be responsible for the payment of any charges applied by your bank to the transfer and/or to any currency exchange.

Credit cards are subject to verification and authorization by the card issuing entity, but if the entity does not authorize the payment, we shall not be liable for any delay or failure to deliver, and we will be unable to conclude Contract with you.

By clicking on the “PAY” button, you are confirming that the credit card is yours or that you are the legitimate holder of the Gift Card, as applicable.

We will not accept your Order, neither will we supply the Products to you until we receive confirmation from our bank that the payment has been successfully credited to our bank account. We reserve the right to verify the identity of the bank account holder by requesting appropriate documentation. We take all reasonable care to make the Website secure and to prevent frauds.

Please note that we may, at any time and at our sole discretion, restrict shipping to certain customers and countries.

For online payments we accept Visa and MasterCard.

Payment by credit/debit card.

You must supply your card details when you place your Order. On the page for entering bankcard data, you will need to enter: card number, cardholder name, card expiration date, three-digit security code (CVV2 for VISA, CVC2 for MasterCard). Your credit card will be debited for the total amount of the Order Processing Receipt or the Order Confirmation Receipt (if you have placed a PreOrder) and Order Summary.

Payment by e-Wallet.

Apple Pay

If you have installed the Apple Pay app and activated the Apple Pay option and you are navigating through Safari, you may choose such payment method. If you choose Apple Pay as an option, a popup window will be displayed and you will need to select the preferred card connected to your account. Once completed, you will need to click on “proceed” button and authenticate yourself through Face ID or Fingerprint and validate the payment. In the event of payment via Apple Pay, the total amount due will be debited by Apple Pay as the conclusion of Order placement. In the event of the termination of the Contract for sale and purchase of Products and for any other type of refund, for any reason, the refund will be credited to your Apple Pay account that you used for the original purchase. The time required to credit the payment back to the account depends exclusively on Apple Pay and the banking system. Once the credit Order in favor of specified account has been arranged, KORA cannot be held responsible for any delays or omissions in crediting you with the refund. To dispute these cases, you must contact Apple directly.

Google Pay

If you have installed the Google Pay app and activated the Google Pay option, you may choose such payment method. If you choose Google Pay as an option, a popup window will be displayed and you will need to insert your shipping and billing address and select the preferred card connected to your account. Once completed, you will need to click on “proceed” button and authenticate yourself through fingerprint and validate the payment. In the event of payment via Google Pay, the total amount of your Order will be debited by Google Pay as the conclusion of Order placement. In the event of the termination of the Contract for sale and purchase of Products and for any other type of refund, for any reason, the refund will be credited back to Your Google Pay account that you used for the original purchase. The time required to credit the payment back to account depends exclusively on Google and the banking system. Once the credit order in favor of specified account has been arranged, KORA cannot be held responsible for any delays or omissions in crediting you with the refund. To dispute these cases, you must contact Google directly.

For payments initiated through e-Wallet, You are reminded and accept that an e-receipt will be issued and that a paper receipt will not.

Payment by wire transfer.

8. GIFTS

You may purchase Products as a Gift or a Gift Card and have it sent to a different recipient.

By making a Gift purchase, you represent that you have permission to provide to us information belonging to the Gift recipient. Please note that you will be liable for providing the recipient’s personal data in compliance with any applicable privacy law. We invite you to consult our Privacy Policy on the Website before providing us with a third party’s personal data.

We retain the right to reject your order for any reason if we believe that you may not have proper authorization to provide us with third party information, including, but not limited to, recipient name or address.

We will send the Gift to your recipient in reliance upon your representations.

You will receive an e-invoice for your Order and the Order Confirmation from us confirming that we have accepted your Order. 

You will receive Order Completed e-mail when your Gift has been shipped to the recipient with shipping information and estimated delivery dates.

9. ORDER PROCESSING

After you have placed your Order through the Website or by using other official channels for distance selling process, we will send you the Order Processing Receipt by e-mail, which contains your relevant identifying Order number, details of the Product(s) you have ordered from us, the price of each Product, shipping charges, TOTAL amount due, your payment and delivery details.

Customers must verify that all information in the Order Processing Receipt, including but not limited to all details concerning the Products, the delivery address and all personal information, is correct. If any information in the Order Processing Receipt is not correct or accurate or if you do not receive the Order Processing Receipt within 12 hours of placing the Order, contact us at +38.06.72087742 or by e-mail at knitwear@kora.ua before you try to place another Order for the same Products.

Please note that the Order Processing Receipt is an acknowledgement that we have received your Order and your Order is being processed, and it is not an Order Confirmation or acceptance of the Customer’s purchase proposal.

Together with the Order Processing e-mail, you will receive an e-invoice for your Order.

You expressly authorize us to issue the invoice in electronic format (e-invoice). However, at any time, you can request a hard copy of your invoice by contacting our Customer Service, and we will issue and send you the invoice on paper.

10. ORDER CONFIRMATION (Contract)

No Contract will exist between you and us with regard to any Product until your Order has been confirmed by us.

The term of Order Processing and Confirmation by “The Seller” is 1-2 working days.

We may at our sole discretion and at any time, choose not to confirm your Order for any reason whatsoever without any liability to you, including but not limited to cases when:

– You provided us with incorrect information, including without limitation, insufficient or incorrect payment details; incorrect billing information; insufficient or incorrect shipping address; or fraudulent information; or

– There is an error on the Website relating to the Products that you have ordered, for example an error relating to the price or description of the Products as displayed on our Website; or

– The Products that you have ordered are out of stock and no longer available through our Website;

– The amount of the proposed transaction is excessively high, based on our case-by-case evaluation, and subject to our discretion; or

– Order does not correspond to the normal consumer requirements (a condition that applies both in relation to the number of products purchased within a single order and in the case of a number of orders relating to the same product, even if each order includes a quantity of Products corresponding to normal consumption needs);

– Shipment of parcels to the delivery address indicated in the Order is restricted, impossible or extremely difficult;

– We believe that you are under the age of 18;

– Guarantees of solvency are insufficient;

– Force Majeure.

If we are unable to confirm your Order, we will contact you at the e-mail address or telephone number that you have provided to us, as soon as possible (within 3 days following receipt of the Order). If your Order is not accepted and a charge has been made to your account, its amount will be refunded in its totality.

“The Seller” cannot be held liable by reason of withdrawing any Product from the Website after an Order placement or for refusing to confirm any Order. KORA does not guarantee that all Products presented on the Website are in stock at the time of your Order.

If some Products turned out to be out of stock, we will contact you shortly, by phone or by e-mail, to verify your interest in the fulfilment of a partial Order, or whether you intend to cancel the Order. If we already have received payment for such Order, we will refund the amount of your Order or a part of it, which was cancelled.

You hereby acknowledge and agree that we reserve the right to confirm your Order in whole or in part.

When using this Website and placing Orders through it, you promise to:  use this Website to make legally valid enquiries and orders only and not to place any false or fraudulent Orders. If it can be reasonably considered that an Order of this type has been placed, we are authorized to cancel it and inform the relevant authorities. 

If you have any questions, comments or concerns regarding your Order, or if you think that we rejected your Order in error, please contact us at the contact details indicated under Section “CUSTOMER SERVICE” of General Terms and Conditions.

Once the Order has been processed, all Products are in stock and the Order is prepared for shipping, an Order Confirmation e-mail will be sent to you with all relevant information about your Order.

At that time, we will refund the amount of VAT-tax, which you will have to pay to the courier upon the receipt of your parcel, back to your card.

These Terms and Conditions, including, but not limited to the relevant Contract between the Customer and KORA for sale and purchase of the Product should only be considered formalized when the Customer receive a separate Order Confirmation e-mail for the purchase proposal from KORA and not earlier.

In accordance with the Contract, “The Seller” undertakes to transfer to the Customer the ownership of the Products specified in the Order placed on www.kora-knitwear.com Website, and the Customer undertakes to pay for and accept the Products in accordance with these “Terms and Conditions of Online Sale”.

The Customer has the right, upon notifying “The Seller”, to withdraw unilaterally from this Contract during the entire period from the moment of Order Confirmation until the actual receipt of the ordered Products.

11. ORDER COMPLETED

After shipping of your Order, you will receive Order Completed e-mail with shipping confirmation and estimated delivery dates. That means that we have completed your Order and constitutes to dispatch confirmation of the ordered products.

12. SHIPPING, DELIVERY AND ORDER TRACKING

International shipping is available when ordering Products from the Website.

“The Seller” dispatches and delivers the Orders using major couriers.

We will not deliver any Products unless or until payment has been authorized by our international payment system and/or credited on KORA’s account. An “Order Completed” e-mail with shipping information and estimated delivery dates is sent to the Customer at the time the Products are dispatched to the courier for delivery. We usually conduct shipping within two business days after Order Confirmation.

Please be advised that shipping costs will apply to your Order. The shipping cost is determined and may vary depending on the place and method of delivery specified by the Customer. Courier cannot deliver packages without receiving a signature and/or payment of applicable customs duties.

The cost of delivery is determined according to the tariffs of the courier.

If your Order is delivered outside of Ukraine, it may be subject to custom duties and local VAT tax. At the checkout, Total cost of Products in your Order (Subtotal) will be reduced by the amount of VAT tax, which you will have to pay to the currier upon the receipt of your Order.                                                     You can review the amounts of duties and VAT taxes in your country by the following link. We are pleased to inform you that we will refund the amount of VAT-tax to your card after Order Confirmation and before shipping.

We will make any reasonable effort to deliver the Products within the number of days specified in your Order Completed e-mail. However, any delivery date or time specified by us is a best estimate only. “The Seller” shall not be held responsible for delays in delivery that are not connected to its fault or negligence. To this extent, “The Seller” shall be exempt from responsibility for delays due to Force Majeure, occurrences related to customs procedures, and any other occurrence relating to the provision of delivery services or any other circumstance outside its control. We will not be liable for any loss or damage suffered by you through any such delay in delivery.

You can track the progress of your Order by entering the tracking number provided in your Order Completed e-mail on the courier’s website indicated in the same e-mail.

Delivery will be made by courier during normal business hours.

Customers are encouraged to do everything in their power to facilitate the delivery of the Order, making themselves available for receipt or delegating to a third party.

If the recipient or other person authorized to receive the Order at the time of the delivery attempt is not available, the courier will issue a written notice containing details of the delivery attempt and the contact details that allow you to set the next delivery appointment with the courier. If you will not contact the courier, it will make a further delivery attempt the following day. If this second attempt is also unsuccessful, the courier will leave written notice containing its contact details and the pick-up point where the Products can be collected. If the Customer does not collect the products from the pick-up point within 10 (ten) days, the ordered products will be returned to our warehouse. If the Order has not been delivered for reasons not attributable to us, we will understand that you wish to cancel the Contract and we will consider it terminated. As a consequence of the termination of the Contract, we will reimburse you for the price paid for such Product(s) as soon as possible, and in all cases, within a maximum of 30 days from the date on when which we consider the Contract to be terminated. In these cases, we will be authorized to charge you for the transport costs deriving from delivery and Contract termination costs.  

In the case where the delivery of the Product(s) to the Customer does not take place within 4 business days after the date indicated in your Shipping Confirmation and the site tracking of Order is impossible through the online courier system, the Customer must notify KORA of the non-delivery of the Product(s) via the contacts indicated in Customer Service section. KORA agrees to guarantee the new shipment of lost Product(s) within 48 (forty-eight) hours following the notification, except in the case when the Product(s) being unavailable, or due to Force Majeure, which will lead to the cancellation of the Order/termination of the Contract and the full refund of the payment amount.

Upon delivery of the Products, and before signing any document attesting delivery (“Delivery Receipt”), you must carefully check the integrity of the package and verify the proper external condition of the Products (absence of mechanical damage, puffs, tears, contaminations, defects and production defects, the presence of decorative elements etc.) and the exactness of the number of Products in the parcel and compliance of the Products with the Order.

In the event of at least one of the above-listed defects, the Customer, who shall notify our customer support service and make a statement about the deficiencies found without undue delay after discovering the defects upon delivery, has the right to:

• terminate These Terms and Conditions of Online Sale, return the Products;

• demand the exchange (replacement) of this Products for the same Products of proper quality in accordance with the Order or for another similar Products.

If the external packaging or the Product is damaged at time of delivery or some Products are missing and the parcel is incomplete in its content please reject the delivery, sign the delivery document conditionally reporting the encountered damage or claim, and contact the Customer Service.

By signing the Delivery Receipt, you acknowledge that the Products and the amount paid is correct. At that moment delivery is deemed to have been completed and the Order is deemed to have been delivered at the agreed delivery address. You hereby waive your rights to any refund or reimbursement and you will not be able to bring a claim in relation to the delivery if you fail to comply with these provisions.

The signature of the Delivery document is an unconditional confirmation of the following facts:

• receipt of the ordered Products by the Customer or Recipient of the Products;

• compliance of the ordered Products with the Order for this Products sent by the Customer;

• the Customer has no claims regarding the quality and completeness of the ordered Products.

At the moment you accredited the receipt of the order by signing the Delivery Receipt at the address specified this Contract is considered fulfilled. As soon as we have delivered the Products to you, you will become responsible for them and for any loss or damage to them thereafter.

If any defects or damage are discovered after receiving the Order and signing the document of the established form, the return of the Products may be refused. The refusal of the Customer or the Recipient to accept the Products, which are of appropriate quality, complete and fully correspond to the Order and/or the refusal to sign the Delivery Receipt, is considered a unilateral full withdrawal of the Customer from this Contract, which, accordingly, has the effect of terminating in full of all obligations of “The Seller” that arose from this Contract, except for obligation to return the costs paid by the Customer for the Products minus shipping costs (in the case if such costs were paid).

13. TRANSMISSION OF RISK AND OWNERSHIP OF THE PRODUCTS

Products that we deliver to you will become your property and The product risks shall pass to you from the moment of delivery. You will take ownership of the products when we receive full payment of all amounts due for the Order, including shipping charges, and upon signing the Delivery receipt by you at the time of delivery.

14. HOW DO I RETURN/EXCHANGE A PRODUCT?

Thank you for ordering from us!

You can withdraw from the Contract and return the purchase at any time starting from the moment of Order Confirmation and within 14 days from the delivery date indicated in the Delivery Receipt by notification of “The Seller” and/or filling out the Return Form in your Personal Account.

Please note that if you cancel your Order after it has been shipped, delivery costs will not be reimbursed and will be deducted from the cost of your Order.

KORA will replace or refund any Product purchased from the online KORA Store that does not conform to your expectations, if you submit your request and make a return within 14 days from the Product delivery date. This date is determined by the courier tracking system and indicated in the Delivery Receipt. For this purpose, terms and conditions explicated in “Terms and Conditions of Online Sale” apply. Customers should dispatch the Products for return from the same country where the Products were first delivered.

The return/exchange of Products of proper quality, as well as the return/exchange of Products with significant defects, is carried out by the Seller on the basis of the Customer’s application.

The return/exchange of Products of proper quality, as well as the return/exchange of Products with significant defects, is carried out by the Seller if the Customer has the relevant payment document of the established form (receipt, sales receipt or cash register receipt) confirming the sale of the Products to the Customer, with a note on the date of sale of the Products.

The following policy applies only to Products that are purchased on our Website. We cannot accept returns/exchanges of Products purchased on other websites or off line stores, in physical KORA Stores, or Products from countries where we do not ship merchandise directly.

Each Product can be exchanged or returned one time only.

Please note we only accept exchanges for changing the color or size of the same Product (same reference number) already purchased. If you would like a different Product, please return your purchase and place a new Order.

Exchanges are subject to our approval. In the event you want to exchange the color or size of the same Product already purchased, you should contact our Customer Service and we will assist you with an exchange. As all exchanges are subject to Product availability at our warehouse, we have to check and ensure that the selected dimensions are available for the exchange.

If the selected exchange Products are not available in stock, KORA will not be able to accept the request for exchange. In this case you can make a return or keep the original Products, or exchange the received Product for another similar Product upon its first availability for sale. In this case, the Seller undertakes to notify the Customer of this on the day such Product is available for sale.

Please note that shipping costs for returns/exchanges as well as the customs duties and taxes are at the customer’s expense, except cases when the return is made due to our fault (damaged, faulty, defective, incorrect Products or Products different from the ordered).

Please note that when the Products are returned to us, we will review them for quality control. If the Products are sent back in perfect condition, new, unused, and with all of the tags and labels attached, we will accept the return/exchange request and, as the case may be, exchange the Products or reimburse the total amount paid minus original shipping costs and possible customs duties and taxes to the credit card or bank account used for the original purchase in accordance with the applicable regulations. In case of payment by wire transfer received from a country outside the Ukraine, you will be contacted by our Customer Service to obtain all necessary information in connection thereto.

In the event the return request is accepted, we will send you a return confirmation email and inform you once we have arranged the order to credit the refund to the card.

We will credit the refund to the credit card, within approximately seven (7) days from the date that we receive the returned Products, save for possible delays of technical nature not attributable to us (e.g.: malfunctions of the credit card system). You remain responsible for any charge applied by your bank.

In the event an exchange request is accepted, we will provide you with a new tracking number in exchange confirmation e-mail.

The shipment will take place within thirty (30) working days from the date on which KORA was informed of the request for exchange. The costs for shipping of the exchange products will be borne by you.

In cases where the Products appear to be worn or used, are missing any of the labels or tags, do not comply with our “Terms and Conditions”, are sent from countries where we do not ship directly or where we have any reason to believe that the Products were not purchased directly on our Website, we will not be able to accept the return/exchange.

You will receive a notification if the return/exchange products cannot be accepted because the above conditions have not been met. In this case, you can choose to have return the original Products at your expense and we will send the Products back to you. If you refuse the above delivery, KORA reserves the right to retain the products and the amount paid for the purchase of the same.

Customers acknowledge and agree to be liable for any loss or damage to the Products during the return process.

“The Seller” may refuse to accept any further Orders from a Customer after multiple returns on previous purchases by the same Customer.

Return and exchange of Products purchased online can be done in 3 easy steps:

1. Please login to your Personal Account. At the “Product Return “section you will find “The online return form”, you can complete it or just complete the same printed version of the “Return form” you will receive in your parcel. Alternatively, you can contact the Customer service for returns; Customers are kindly requested to specify the unique identifying number of the Order. If possible, please provide a reason for the return or exchange so we can better serve you in the future.

2. Place all Products for return/exchange new, unused, not altered and in perfect condition with all of the tags and labels attached in boxes and packaging along with the filled “Return form” if you haven’t filled in online form and printed e-invoice for original Order.

3. You can find the return address in “Return form” and visit the courier. You can either contact the courier, which was provided by the “The Seller” or indicated by “The Seller” in the “Return form” or choose any other at your discretion and deliver the parcel to the courier or bring it to the drop off point. You can also contact our Customer service and we will arrange the collection of the Products directly with the Customer. KORA Products must be delivered to the courier for shipment or to the drop off location within 14 days.

If you return a Gift, only the original purchaser will be entitled to receive a refund therefore you will be contacted by the Customer Service to obtain all the necessary information in connection thereto.

Return of damaged, faulty, defective, incorrect Products or Products different from the ordered (Non-conforming Products)

“The Seller” assumes responsibility for every defect in the Products.

For technological reasons, neither KORA, nor the Website can guarantee that the visualization of the colors on the screen will always be accurate.

“The Seller” guarantees the Customer that the Products are not defective or flawed and that the Products conform to the Product description given by “The Seller” (us) on this Website.

Minor differences between the Product description on the Website and the actual Product features should not be deemed to lead to any non-conformity of the Product for the purposes of these “Terms and Conditions of Online Sale” and the present Contract. In particular, the differences up to 2 centimeters in knitwear Product measurements are acceptable.

Customers are invited to inspect carefully any parcel before signing and confirming the completed delivery (“Delivery Receipt”) as indicated in “SHIPPING, DELIVERY AND ORDER TRACKING” section

In the event that any Product is Non-conforming, defective, Customer remedies shall be limited to those described in these “Terms and Conditions of Online Sale”. Under no circumstances shall “The Seller” be liable for claims for any damages, whether direct, immediate, foreseeable, incidental, consequential or special or for any expenses incurred by reason of the use or misuse, sale or fabrication of Products which do not conform to the Order or the Product description on the Website.

These “Terms and Conditions of Online Sale” shall not affect any local statutory consumer rights.        

We would like to inform Customers that KORA submits its Products and materials with which they are made to strict quality controls, ensuring that they are sold in perfect condition. In addition, for greater remote purchasing protection, every single item shipped by KORA is checked before being shipped.                                                                         

If we are unable to repair or replace the Products promptly and satisfactorily, the Customer has the right to request a full refund of the price of the non-conforming Product and we will refund the price paid for the Products together with the original delivery costs to the credit card or bank account used for the original purchase.

In the unlikely event of a Product being defective, flawed, damaged, non-conforming to the Order or the Product description on this Website, Customers are entitled to ask that the Product is replaced/repaired free of charge within a reasonable period and without major inconvenience to the Customer.

All delivery costs associated with the exchange/return of non-conforming Products or Products with significant defects are borne by the Seller.

Under no circumstances will tailoring changes be made to the Products purchased since these would be overly costly for KORA. Likewise, no costs that the Customer incurs in order to make tailor-made adjustments and/or alterations to the Product purchased will be reimbursed, and will therefore remain at the exclusive expense of the customer.                                                                                

In order to submit a claim for Non-conforming Product and replace/return the concerned Product, Customers shall contact the Customer service and agree on the modalities of the replace/return.

15. FAULTY/DEFECTIVE PRODUCTS – Guarantee

KORA ensures 30 days guarantee on all faulty/defective Products.

KORA is responsible of any lack of conformity, already existing at the time of the delivery of the Product.

Any complaint for lack of conformity must be communicated to KORA without undue delay after discovering of the last with a description of the non-conformity.

Please note that when the Products are returned for quality problems, we will examine them and will provide you an assessment.

The warranty for lack of conformity will be applicable only if the Products have been used correctly, in compliance with its intended purpose and in accordance with Product care tips, use and washing instructions and the instructions set out on the Product labels.

Therefore, if we reasonably believe that the Products you have returned to us are not faulty/defective and do not have quality problems, if the or if the Products have been damaged due to misuse, noncompliance with Product care tips or were returned to us later than the above mentioned deadline, no warranty will be applied and you will not be entitled to replace/return the Product and we will return the original Products to you at your expense after your agreement. If your replace/return request is rejected, any additional shipping costs, customs duties and taxes will not be refunded.

However, you must be able to show when the Products were purchased by keeping the Delivery Receipt that you received from the courier upon the receipt of the parcel. This policy applies both to online Products purchased by you online and Products you received as a Gift.

Any such refund made to you shall be reduced to take account of the use that you have had of the Products since its delivery.

In case of detection of defects during the established warranty period, the Seller acts in accordance with Article 8 of the Law of Ukraine “On Protection of Consumer Rights”.

In case of expiration of the warranty period, complaints regarding defects are not considered

16. OUR LIABILITY TO YOU

For violation of its obligations under these “Terms and Conditions of Online Sale”, the Seller shall be liable in accordance with the current legislation of Ukraine.

The Seller shall be released from liability for full or partial failure to fulfill its obligations under these “Terms and Conditions of Online Sale”  if such failure was the result of force majeure circumstances.

Nothing in these “Terms and Conditions of Online Sale” will exclude or limit our liability to you caused by our fraud or gross negligence, by breach of terms regarding title implied under the Consumer Code/ Ukraine Consumer Protection Law as for Products shipped within Ukraine or to other countries or any other liability, which the applicable laws or any mandatory provisions of applicable law state may not be excluded or limited.

The Customer can legitimately rely on the observation of Material contractual obligations, which are precondition to the successful fulfilment of the Contract. In the event of a violation of Material contractual obligations, KORA’s liability is limited to the foreseeable and typical damage if such damage has been caused by slight negligence, unless a damage to health, body and mind is concerned. The limitations set forth above also apply for the benefit of the KORA’s official representatives if claims are made directly against them. The liability under the Product Liability Directive (PLD) remains unaffected.

Our liability to you regarding any Product(s) purchased through the Website is limited to the price of such Product(s).
